Federal Judge Denies Effort to Block Colorado’s Ban on “Ghost Guns”

On May 2nd, a federal judge found Colorado’s ban on homemade firearms does not infringe on the Second Amendment’s right to bear arms.

The lawsuit was filed in January by the National Association for Gun Rights and it’s Colorado-state affiliate, Rocky Mountain Gun Owners (RMGO) to challenge the prohibition on unserialized firearms.

Judge Gordon P. Gallagher found:

“[Colorado’s law] does not prevent an individual from buying an unfinished frame or receiver or firearms parts kit and in no way infringes [on the right to acquire arms.]”

Under Colorado’s law, buyers must have the frame or reciever serialized by a federal firearms licensee, including for past purchases, and perform a background check.

Meanwhile, U.S. Supreme Court justices have agreed to take up a Biden Administration rule that changes the federal definition of a firearm to include unfinished parts.

The case could be heard before the Supreme Court as soon as this fall.
