In Gov. Ron DeSantis’ State of the State last week, he made it clear he wants to do away with the state’s “Extreme Risk Protection Order,” among other fixes to firearm-related laws.
Enacted in 2018 and signed into law by then-Governor Rick Scott, now-Governor Ron DeSantis has called to repeal the unconstitutional law, which also included raising the minimum age for buying a firearm to 21, and added the purchase of long guns to the state’s three-day waiting period.
The bipartisan bill states, “if approved by a judge, law enforcement can confiscate firearms from people deemed to be a danger to themselves or others, or someone who has been adjudicated as ‘mentally defective.'”
DeSantis argues the law is unconstitutional and if that bill had come across his desk as Governor, he would have vetoed it.
Continuing on, DeSantis stated:
“They can go in and say, this person’s a danger. They should have their firearms taken away, which is property in addition to being something connected with a Constitutional right. And then the burden shifts where you have to prove to a court that you are not a menace or a threat. That’s not the way due process works.”
Currently, 21 states and the District of Columbia recognize some form of “Red Flag” Gun Confiscation.
Among other firearms-related legislation in Florida, Florida Gun Rights is aiming to fix the permitless carry law to legalize open carry in the Sunshine State.
Governor Ron DeSantis has called on the Legislature to do so, saying this on X (formally Twitter):
“Would be great to see [open carry] hit my desk – Florida needs to join the overwhelming majority of states and protect this right…”
