H.R. 850: Silencers Help Us Save Hearing (SHUSH) Act

- REMOVES silencers from the National Firearms Act (NFA) regulation. Silencers would no longer be classified as NFA items, eliminating the current tax stamp requirement, lengthy ATF approval process, and registration requirements.

- RETROACTIVELY applies tax relief for suppressor transfers. The bill eliminates the $200 tax stamp for future purchases and retroactively refunds tax payments for silencers transferred up to two years prior to enactment [S.345], or transfers from October 22, 2015 [H.R. 850].

- RECLASSIFIES silencers as standard firearm accessories. Suppressors would be treated like other firearm accessories rather than regulated as firearms themselves, removing them from the definition of “firearm” under federal law.

- ELIMINATES enhanced federal penalties for crimes involving silencers. Removes sentencing enhancements and penalties for possessing a firearm equipped with a silencer, bringing them in line with standard firearm penalties.

- PREVENTS Consumer Product Safety Commission (CPSC) from regulating silencers. Explicitly exempts silencers from CPSC oversight, preventing future regulatory overreach.
