Group files Temporary Restraining Order and Preliminary Injunction in Naperville, Illinois to halt the ordinance banning semi-automatic rifles
Naperville, IL. – Today, the National Association for Gun Rights filed a Motion for Temporary Restraining Order (TRO) and Preliminary Injunction (PI) in its lawsuit seeking to overturn a Naperville, Illinois ordinance which bans the sale of semi-automatic rifles. The Naperville gun ban was passed over the strenuous objections of citizens, led by the plaintiff for the National Association for Gun Rights, a local gun store owner who faces being put out of business if this ban takes effect.
“We’re filing this motion for temporary restraining order to stop the City of Naperville from putting NAGR member Robert Bevis out of business by trampling on his Second Amendment rights,” said Dudley Brown, President of the National Association for Gun Rights. “Under the Second Amendment and the Supreme Court’s Bruen ruling, the city doesn’t have a leg to stand on and we look forward to stopping their outrageous schemes in court.”
If the courts agree, the temporary restraining order will function as an emergency stop action to the unconstitutional ordinance before it can go into effect, and the preliminary injunction will last throughout the duration of the lawsuit.
The motion states in part: “[T]he Banned Firearms are ‘typically possessed by law-abiding citizens for lawful purposes.’ Under Heller and Bruen, that is the end of the analysis. The Second Amendment does not countenance a complete prohibition on the commercial sale of one of the most popular weapons chosen by Americans for self-defense in the home.”
“Already a federal judge granted us a restraining order in our Colorado case challenging a similar gun ban over the Bruen decision, so we’re optimistic that this court will agree to put a hold on this gun control ordinance too,” concluded Brown.
