The Fifth Circuit Court of Appeals ruled today that the Firearms Policy Coalition’s claim against the ATF’s pistol brace rule is likely to succeed with Judge Don R. Willett adding that the ATF’s pistol brace rule likely violates the Second Amendment.
The National Foundation for Gun Rights along with Texas Gun Rights and Wisconsin Institute for Law and Liberty (WILL) has a similar suit filed (June 8,2023) against the ATF in the Northern District of Texas click here to view.
NFGR is seeking a preliminary injunction to protect their members from the ATF’s enforcement of this rule for the duration of the litigation.
“The Fifth Circuit’s ruling is a victory for the Second Amendment and for law-abiding gun owners. The National Foundation for Gun Rights expects a similar ruling to come down in our case in the Northern District of Texas,” said Hannah Hill, Executive Director of NFGR.
“Hopefully, it is just a matter of time before all of the ATF’s adverse firearms rulings come unraveled in the Justice System. I pray this is the beginning of the end of the ATF legislating by bureaucratic decree,” said Dudley Brown, President of the National Association for Gun Rights.
